Water Use Licences and Management

The National Water Act, 1998 (Act 36 of 1998) requires that all water uses must be authorised (i.e. license, general authorisation, Schedule 1, Existing lawful use) in order to uphold sustainable use of water for the benefit of all users. The most common water uses includes the taking and storing of water, the disposing of waste water, and the impeding or diverting of rivers/streams etc.

Schedule 1 use and General Authorisations allow relatively small water uses without the user having to apply to the Department (although the use may have to be registered), but large users will have to apply for a licence from the Department.

The water use licence process consists out of the water use licence application (including DW forms, title deeds, ID documents, relevant agreements and Section 27 motivation) as well as the technical supporting documents (EIA section, Environmental Risk Assessment, Cost Benefit Analysis, Monitoring and Management Plans/Strategies) as well as Integrated Water Resource Management Plans (IWRMP) or Integrated Water and Waste Management Plans (IWWMP).

Waste Management and Licensing

The National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) [NEMWA] are one of the latest legislative pieces which has tremendous implications on the management of waste within the country. Various activities have been identified that requires an application for a Waste Management Licence in accordance to Section 20(b) of the said Act, through either a Basic Assessment [Category A] or an Environmental Impact Assessment [Category B] as contemplated in the National Environmental Management Act, 1998 (Act No. 107 of 1998).
